These are the terms and conditions (the “Terms”) which will apply to your purchase of all our products from our website www.behansfruitandveg.ie (the “Website”). These Terms form the basis of a legally binding contract between Behans Irishtown Country Market and you. Please read the Terms carefully before accepting them and buying anything from the Website.

We will endeavour to correct all information errors on the Website as soon as reasonably possible and if we reasonably think that such an error has affected your purchase of Goods we will attempt to contact you. Placing Orders

Buying Goods
 / Orders can be made online at times that are convenient to you. However please note that orders will only be processed during normal business hours Monday to Friday. Behans Irishtown Country Market reserves the right to refuse to sell or supply goods to any person or company for any reason.

You make an offer to purchase product(s) from Behans Irishtown Country Market (your “Order”) by completing the ordering process on the Website. Your Order only constitutes an offer to purchase goods and does not form a binding contract until accepted by Behans Irishtown Country Market. On receipt of your Order, we will send an order acknowledgment to the email address you provided during the ordering process. When payment for goods and delivery charges if any, have been processed we will send a confirmation order dispatch email and the sending of that email makes the contract between Behans Irishtown Country Market and you. If a product is not available we will include details of the unavailable product we will contact you and offer an alternative or a refund for that item. An order is accepted by Behans Irishtown Country Market only when payment in full to include delivery charges has been processed and received and then the Goods will be dispatched.

Promotions and Discounts

Online offers and promotions are generally not available in our stores unless otherwise indicated. Store offers and promotions are not generally available online unless otherwise indicated. All offers are exclusive and may not be used in combination unless otherwise stated.

Payment and Pricing

All prices are displayed in Euros and include VAT at the applicable rate. Delivery charges if applicable are not included. If you are purchasing with a non-euro credit card the exchange rate shown on your statement is set by your card provider and not by Behans Irishtown Country Market. Behans Irishtown Country Market reserves the right to alter prices without prior notice and to withdraw from sale any products advertised online at any stage without prior notification.

Credit Card Security

All transactions are processed by a third party credit card processing gateway. All transactions are highly encrypted and your card details are never retained by us or any other party.

Shipping Information

We will only deliver to Republic of Ireland addresses. Order values for less than €60 will incur a fee of €8.00 unless the address of delivery is in the Athlone area. All orders outside of the Athlone area we use a courier company for all deliveries and a signature will be required on delivery.

We will endeavour to dispatch your order within 1 working day of receipt of your order. Deliveries within Ireland are mostly delivered next-day after dispatch. Feel free to query your order at any stage at behansfruitandveg@gmail.com

Cancelling Orders & Returns

You may cancel your order by notifying us at behansfruitandveg@gmail.com within 2 hours of placing your order for same-day delivery. Only orders placed before 12 midday will have same-day delivery. For next day delivery you can cancel your order up to 6 hours . The notification should state your order number and reason for cancellation. You can no longer cancel your order once your order has been dispatched for delivery. However your statutory rights regarding quality will remain unaffected. Behans Irishtown Country Market will refund the purchase price to the payment card used at the time of purchase once written notification has been given and received at behansfruitandveg@gmail.com. We will confirm cancellation by email only. Nothing under these terms and conditions affects your statutory rights.

Cancellation by us

We reserve the right to cancel the contract between us if we have insufficient stock to deliver the goods you have ordered; if we do not deliver to your area; or if one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for any disappointment suffered.

General

Behans Irishtown Country Market will not be responsible for the performance of any obligations under these terms and conditions in the case of an event outside of our reasonable control including but not limited to strikes, lockouts, failure of third parties systems or networks acts of God, fire, earthquake, storm, flood or other natural disasters, civil unrest, acts of terrorism deliberate sabotage of or malicious damage to equipment or data or damage to or destruction of premises.

Behans Irishtown Country Market warrants that the goods supplied are of satisfactory quality reasonably fit for all the purposes for which these goods are normally supplied.

Behans Irishtown Country Market does not accept liability for any loss, direct, indirect or consequential, which may arise as a result of the use or the purchase of goods from this website or from reliance on information contained on this website or in respect of any error or omission, except in relation to death or personal injury caused by our negligence. This does not include or limit in any way our liability for any matter for which it would be illegal for us to exclude or attempt to exclude our liability.

You agree and we agree to submit to the exclusive jurisdiction of the Irish Courts for the determination of any disputes.
